Dais Records – Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Dais Records website and online store (together, the “Site” and “Store”) and any purchases you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site or Store.

 

1. About Us

Dais Records, LLC (“we”, “us”, “our”) operates the Site and Store. Contact details and customer support information are available on the Site.

 

2. Eligibility and Use of the Site

2.1   To use the Store, you must be at least 18 years of age or the age of majority in your place of residence.

2.2   You may not use the Site or Store if you are subject to, or located in a jurisdiction subject to, U.S. or other applicable economic sanctions.

2.3   The Site and Store are provided for personal, noncommercial use only.

2.4   We may interrupt, change, or discontinue the Site or Store, or suspend, refuse or terminate your access to the Site or Store, at any time for any reason.

 

3. Accounts and Security

3.1   Some purchases may require you to create an account.

3.2   You must provide accurate account, shipping, and payment information and keep your information updated.

3.3   You are responsible for keeping your account credentials secure and for all activity carried out using your account.

3.4   You must notify us promptly of any unauthorized access or security breach affecting your account.

 

4. Products and Availability

We offer physical merchandise, digital downloads, streaming content, and related products.

4.1   All products are subject to availability.

4.2   We may limit quantities, discontinue products, or change product specifications at any time.

4.3   Product images and descriptions are for guidance only; colors and appearance may vary depending on your device.

 

5. Prices and Payment

5.1   Prices shown on the Store may change at any time before you place an order, and may be corrected if displayed in error.

5.2   Unless otherwise specified, prices exclude taxes, shipping, handling, or other charges, which will be displayed before checkout.

5.3   We may use thirdparty payment processors and fraudprevention services.

 

6. Orders and Contract Formation

6.1   Placing an order constitutes an offer to purchase.

6.2   A binding contract is formed only when we send you a dispatch confirmation (for physical goods) or access instructions (for digital content).

6.3   We may reject, cancel, or limit quantities purchased in an order at any time before dispatch or delivery. If payment has been taken, you will be refunded.

 

7. Delivery

7.1   Physical Goods

(a)    Delivery dates indicated are estimates only and not guaranteed.

(b)    Risk of loss passes to you upon delivery to the address provided.

(c)     Ownership transfers to you once full payment has been received by us.

7.2   International Orders

(a)    International deliveries have longer delivery times and may be subject to customs duties, taxes, and local requirements.

(b)    You are responsible for all import duties, taxes, and compliance with local laws applicable to your orders.

 

8. Cancellations, Returns and Refunds

8.1   Physical Products

(a)    You may cancel an order for physical goods at any time before dispatch.

(b)    After delivery, returns are accepted only in accordance with our Returns Policy and applicable law.

(c)     Certain items, including limited edition, final sale, custom, worn, washed, or unsealed audiovisual products, are nonreturnable unless faulty.

(d)     

8.2   Refunds

(a)    Approved refunds will be issued using the original payment method.

(b)    Shipping costs will not be refundable unless required by law or where goods are faulty.

(c)     Refunds will be limited to the cost of the item, excluding shipping, where items rejected by customs or not picked up from the post office.

(d)    Refunds may be reduced to take account of any damage to the returned goods.

(e)    No refunds will be made for items lost or stolen due to negligence or provision of a wrong address (unless due to our fault).

(f)      If you are located in the EU, EEA, or UK you have additional rights as set out in the Schedule to these Terms.

 

9. Digital Content

(a)    Digital content is provided for personal, noncommercial use only.

(b)    You may cancel digital content purchases within 14 days unless you have begun downloading or streaming, in which case you lose the right to cancel.

(c)     If digital content is defective, we will repair, replace, or refund it as required by law.

(d)    Digital rights management or other usage restrictions may apply.

 

10. User Content and Acceptable Use

10.1       User Content

(a)    Any comments, feedback, or other content you submit may be used and published by us without restriction or compensation.

(b)    We do not accept unsolicited creative submissions.

10.2       Acceptable Use

You and the content you post or submit must not:

(a)    violate any law or thirdparty rights (such as copyrights, publicity rights, or privacy rights);

(b)    be obscene, illegal, or objectionable, or contravene our policies;

(c)     defame, discriminate against, harass, abuse, or offend any person;

(d)    interfere with the security or operation of the Site or Store;

(e)    upload malware or harmful code;

(f)      scrape or harvest data;

(g)    impersonate others or provide false information; or

(h)    use the Site or Store for unauthorized commercial purposes or spam us or any user.

We may delete content, or suspend or terminate your access to the Site or Store, your account, or your agreement with us under these Terms, in case of any suspected or actual breach of these Terms. Termination does not affect your or our accrued rights, obligations or liabilities.

 

11. Intellectual Property

All content on the Site and Store, including trademarks, logos, text, images, audio, and video, is owned by us or our licensors and is protected by law. You may not copy, reproduce, or exploit any Site or Store content without our prior written consent, except for normal browsing and use of the Site and Store. Third party links, ads, or tools on the Site or Store are not controlled by us and we do not accept responsibility for them.

 

12. Warranties and Liability

(a)    We warrant that goods will be of satisfactory quality as required by applicable law.

(b)    Except as required by law, the Site and Store are provided on an “as is” and “as available” basis. All other warranties are excluded, e.g. in relation to availability, correctness, completeness, or non-infringement of the Site, Store, or any products.

(c)     To the maximum extent permitted by law, our liability is limited to the price paid for the relevant product.

(d)    To the maximum extent permitted by law, we are not liable for losses of profits or anticipated savings, loss of data or your content, or indirect or consequential losses.

(e)    Nothing in these Terms limits our liability to the extent that cannot be excluded under applicable consumer protection or other laws.

 

13. Indemnity

You agree to indemnify us, including for reasonable attorneys’ fees, against claims arising from your breach of these Terms, misuse of the Site or products, any content you provide, or violation of applicable laws or of any rights of third parties.

 

14. Events Outside Our Control

We are not responsible for delays or failures caused by events beyond our reasonable control including without limitation technical issues, shipping delays, government activity, industrial action, terrorist action or armed conflict.

 

15. Changes to These Terms

We may update these Terms at any time. The version in force at the time you use the Site or place an order will apply.

 

16. Personal Information

Any personal information that we collect or receive will be processed in accordance with our Privacy Notice.

 

17. General

(a)    If any part of these Terms is or becomes illegal, invalid or unenforceable, this shall not affect the remaining parts, which shall remain in full force and effect.

(b)    These Terms and any other instructions or policies on the Site or Store override any other oral or written indications or discussions.

(c)     Failure or delay on our part to exercise or enforce any of our rights is not a waiver of those rights.

(d)    Rights and remedies specified in these Terms are cumulative and in addition to any remedies available at law or in equity.

(e)    Views and opinions expressed on the Site or the Store do not necessarily reflect our views.

(f)      Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

 

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California. The courts located in Los Angeles County, California have exclusive jurisdiction, subject to any mandatory consumer protection laws applicable to you e.g. if you are a EU, EEA, or UK consumer.

Schedule – EU, EEA, UK Consumer Rights

 

This Schedule applies only to consumers resident in the EU, EEA or UK, and applies where mandatory consumer law requires it.

 

1. Statutory Rights

Nothing in these Terms limits or excludes your statutory consumer rights. Where there is a conflict, your statutory rights prevail.

 

2. Right to Cancel

(a)     Physical goods: You have a right to cancel within 14 days from the day of delivery.

(b)     Digital content: You have a right to cancel within 14 days unless you request immediate access and acknowledge that you lose the right to cancel once downloading or streaming begins.

 

3. Refunds

(a)     Approved refunds will be issued within 14 days after cancelation, using the original payment method.

(b)     For physical goods, unless goods are faulty or incorrect, we reserve the right to require you to return items and pay for return costs.

 

4. Exceptions

The right to cancel does not apply to:

(a)     sealed audio or video recordings once unsealed;

(b)     digital content after downloading or streaming has begun with your consent;

(c)     personalized or made-to-order items;

(d)     limited edition or final sale items clearly identified at purchase;

(e)     goods that have been worn, washed, or damaged.

 

5. Faulty Goods and Digital Content

If goods or digital content are faulty or not as described, you are entitled to repair, replacement, or refund as required by applicable law, and we will bear reasonable return costs.

 

6. How to Exercise your Cancelation Rights

You can communicate your cancelation to us within the applicable 14-day period by writing to contact@daisrecords.com.
